Terms of Service
Unalone is a WhatsApp-based digital wellness companion offering general information, motivation, stress-management support, and fitness ideas. It is not a doctor, therapist, counsellor, dietitian, trainer, or emergency service, and replies may be AI-generated.
1. Who we are
The service “Unalone” (“Service”, “we”, “us”) is operated by [Legal entity — to be confirmed], having its registered office at [Registered address — to be confirmed]. Contact: help@unaloneai.com. Grievance Officer details in Clause 20.
2. Acceptance of these terms
By creating an account, completing checkout, sending a message to our WhatsApp number, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our Subscription, Billing, Cancellation and Refund Policy, our Acceptable Use Policy, and all disclaimers referenced here. If you do not agree, do not use the Service.
3. What the Service is — and is not
The Service provides only general informational, educational, motivational, organisational, lifestyle, fitness, and emotional-support content, delivered primarily via WhatsApp. It is not and does not provide the services of: a doctor, hospital, clinic, therapist, psychologist, psychiatrist, counsellor, dietitian, nutritionist, certified fitness trainer, physiotherapist, lawyer, financial adviser, or emergency or crisis service.
The Service does not diagnose, treat, cure, prevent, monitor, or manage any medical or mental-health condition. No doctor–patient, therapist–client, or other professional relationship is created by your use of the Service. The Health & Fitness Disclaimer, Mental-Wellbeing Disclaimer, Medical Disclaimer, and Crisis & Emergency Disclaimer form part of these Terms.
4. Artificial intelligence
Some or all responses you receive may be generated wholly or partly by AI systems, without real-time human review. AI outputs may be incorrect, incomplete, outdated, biased, delayed, misunderstood, generic, or inappropriate for your situation. You must not rely on them as professional advice.
You are responsible for exercising independent judgment and obtaining advice from a qualified professional before making decisions about health, mental health, diet, fasting, exercise, supplements, medication, finances, legal matters, relationships, employment, or safety. The AI Disclosure forms part of these Terms.
5. Eligibility and age
You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law. We may ask you to confirm your age and may suspend or terminate accounts we reasonably believe belong to persons under 18.
6. Your account and WhatsApp number
The Service is delivered to the WhatsApp number you register. You are responsible for keeping your phone and WhatsApp account secure. Anyone with access to your device or WhatsApp account may be able to read messages from the Service, including via notification previews. You must promptly inform us if your number changes or your device is lost or stolen — we are not responsible for messages delivered to a number that is no longer under your control until you notify us.
7. Subscriptions, trials, billing and refunds
The Service is offered on a paid-subscription basis. Pricing, billing cycles, trials, auto-renewal, cancellation, and refunds are governed by the Subscription, Billing, Cancellation and Refund Policy. All payments are processed by third-party payment providers; we do not store full card numbers.
8. Acceptable use
You must not use the Service unlawfully, abusively, to harm others, to seek prohibited content, to attack or manipulate the Service (including prompt injection intended to compromise it), or as a diagnostic, treatment, monitoring, or emergency tool for yourself or others.
9. Emergencies and crisis situations
The Service is not an emergency, crisis, or suicide-prevention service, and cannot guarantee real-time monitoring, detection of risk, intervention, or rescue. Automated crisis-detection features, if any, may fail, misfire, or respond with delay. If you or anyone else is in danger, experiencing a medical or mental-health emergency, or at risk of harming themselves or others, immediately contact your local emergency services, a qualified professional, a recognised crisis helpline in your area, or a trusted person near you. Do not wait for or rely on the Service. See the Emergency Info page.
10. Intellectual property
The Service, its content, prompts, software, branding, and materials are owned by us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use content the Service provides to you, for personal, non-commercial purposes only. You retain rights in content you send us, and grant us a licence to process it for the purposes described in the Privacy Policy.
11. Privacy
Our collection and use of your personal data is described in the Privacy Policy. The Service involves processing of messages you send, which may include health and wellbeing information you choose to share.
12. Third-party services
The Service depends on third-party services including WhatsApp (operated by Meta), cloud hosting, AI model providers, payment gateways, and analytics tools. Your use of WhatsApp is governed by WhatsApp’s and Meta’s own terms and privacy policies. We are not responsible for WhatsApp’s availability, delivery failures, or Meta’s data practices.
13. Availability and changes
We may modify, suspend, or discontinue features, and we may perform maintenance. We aim for continuous availability but do not guarantee it.
14. Communications
By providing your WhatsApp number, you consent to receive service messages needed to deliver your subscription. Marketing messages are sent only if you separately opt in, and you can opt out at any time.
15. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Nothing in these Terms excludes rights that cannot be excluded under Indian law, including your statutory rights as a consumer under the Consumer Protection Act, 2019.
16. Limitation of liability
Nothing here excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, for fraud, or under non-excludable consumer-protection statutes. Subject to that, and to the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive losses; loss of profits, data, goodwill, or opportunity; injury, loss, or decisions arising from your reliance on Service outputs including AI outputs; acts, omissions, or outages of WhatsApp, Meta, payment providers, hosting providers, AI providers, or other third parties; or unauthorised access to your device or WhatsApp account.
Our total aggregate liability in any 12-month period shall not exceed the total subscription fees you actually paid to us in the 12 months preceding the event giving rise to the claim.
17. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims, losses, and reasonable costs arising from your breach of these Terms, your unlawful use of the Service, or content you submit, except to the extent caused by our own breach or negligence.
18. Suspension and termination
You may stop using the Service and cancel per the Subscription, Billing, Cancellation and Refund Policy. We may suspend or terminate your access, with notice where practicable, if you materially breach these Terms, misuse the Service, create risk or legal exposure, or fail to pay.
19. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, government action, internet or telecom failures, WhatsApp/Meta platform failures, power outages, strikes, or third-party provider failures.
20. Grievance redressal
Grievance Officer: [Name / designation — to be confirmed], email help@unaloneai.com. Complaints will be acknowledged and resolved within the timelines set out in the Grievance Redressal Procedure, consistent with applicable Indian law.
21. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at [City, state — to be confirmed] shall have jurisdiction. Nothing in this clause prevents you from pursuing remedies before consumer fora under the Consumer Protection Act, 2019.
22. General
Severability, waiver, assignment, survival, and entire-agreement rules apply. We may amend these Terms; material changes will be notified via WhatsApp and/or email at least 15 days before taking effect. Continued use after the effective date constitutes acceptance.
